Background

This local constitutional amendment was proposed by Senate Bill 286 of the 2025 Regular Session, sponsored by Senator Hatcher. According to the enrolled bill, it passed the Senate on April 10, 2025 and the House on April 17, 2025.

Under the bill, elected or appointed members of the Montgomery City Council could participate in the Employees' Retirement System of Alabama on the same terms as other employees in that system, and would be treated as city employees.

The bill would let a member in office when the amendment is ratified buy service credit for time already served, and it bars anyone from participating in both a supernumerary program and the Employees' Retirement System.

Put on the ballot by Alabama Legislature, SB286 (2025 Regular Session), Act 2025-181.
