Background

The amendment comes from HB395 of the 2025 Regular Session, sponsored by Reps. Collins and Moore, which passed the House on April 1, 2025 and the Senate on May 14, 2025, according to the enrolled bill.

It would require the Morgan County probate judge to be a licensed Alabama attorney, starting with the term that begins after ratification.

It would also let a licensed probate judge hear equity cases filed in probate court with the same powers as a circuit judge.

Put on the ballot by Alabama Legislature (HB395, 2025 Regular Session).
