Background

The amendment comes from HB90, sponsored by Rep. Hill, which passed the House on January 21, 2026 and the Senate on February 12, 2026, according to the enrolled bill. The Retirement Systems of Alabama posts it as Act 2026-61.

It would let the mayor of a St. Clair County municipality that participates in the Employees' Retirement System join that system on the same terms as other employees. Mayors in office at ratification could buy service credit for their time served.

No one could take part in both a supernumerary program and the Employees' Retirement System based on the same service.

Put on the ballot by Alabama Legislature (HB90, 2026 Regular Session; Act 2026-61).
