Explained

Today

  • The area is in unincorporated DeKalb County, so the county government provides its local services.
  • Residents there do not vote in City of Tucker elections.

If it passes

  • YES would add the area described in the Act to the City of Tucker on January 1, 2027.
  • The area is defined by 2020 Census blocks: one block in the Briarlake Elem voting district and seven blocks in the Midvale Road voting district.
  • According to the city, Tucker would then handle services such as street paving, sidewalks, park planning and property-maintenance code enforcement in the area, and residents could vote in city elections.
  • NO would keep the area in unincorporated DeKalb County. The Act would not take effect and would be automatically repealed on January 1 following the election.

Who would notice

Residents and property owners in the annexation area (the 2020 Census blocks listed in the Act; the city has posted a map), and the City of Tucker.

How it got here

The General Assembly passed Senate Bill 622, sponsored by Senators Kim Jackson, Tonya Anderson, Sally Harrell and Elena Parent, in its 2026 session. It is listed on the ballot as Act No. 704.

The Act requires a special election on November 3, 2026, among voters in the area to be annexed; more than half must vote YES.

Background

Senate Bill 622, passed by the Georgia General Assembly in 2026, would amend Tucker's city charter to add territory described by 2020 census blocks to the city's boundaries.

Under the Act, the DeKalb County election superintendent holds a special election for voters who live in the territory to be annexed. The City of Tucker says only residents of the proposed annexation area vote on the question.

If a majority votes yes, the annexation takes effect January 1, 2027. If a majority votes no, the Act is automatically repealed. The Act requires the City of Tucker to pay the cost of the election.

According to the city, a yes vote would put the area inside Tucker, with specified city services, and a no vote would keep it in unincorporated DeKalb County.

Put on the ballot by Georgia General Assembly, Senate Bill 622 (Act No. 704, 2026), which requires the special election.
