Background
According to the Indiana Election Division's 2026 legislation summary, the question is required by House Enrolled Act 1038 (Public Law 77-2026), effective March 4, 2026. The law directs the county election boards in Allen, DeKalb and Steuben counties to put it on the November 2026 general election ballot.
The summary says the Allen County circuit court clerk must certify the result to the Indiana Gaming Commission and the Department of Revenue.
The summary says the same law makes it a Level 6 felony for a casino licensee, or anyone with an interest in one, to give property to a precinct committee member to influence their actions on the referendum.
