Background
According to the Indiana Secretary of State's 2026 election legislation summary, House Enrolled Act 1038 (2026) requires the county election boards in Allen, DeKalb and Steuben counties to put this question on the November 2026 ballot: "Shall inland casino gambling be permitted in (the county)?"
The law requires each county's circuit court clerk to certify the results to the Indiana Gaming Commission and the Department of Revenue.
The same act makes it a Level 6 felony for a casino license holder, or anyone with an interest in one, to give property to a precinct committee member to influence that member's actions on the referendum.
