Background

This question reached the ballot through a citizen petition to incorporate Niwot, which required 150 signatures of registered electors within the proposed boundary (population 4,306 in the 2020 Census) and was filed with the Boulder County District Court, according to the court-appointed Niwot Election Commission.

According to the commission, if voters also approve incorporation, the nine-member charter commission would draft a home rule charter that would go back to voters for approval at a later election; the commission's members are elected in a separate contest on the same ballot from 28 candidates.

The petition proposes the name 'City of Niwot' because state law classifies a statutory municipality of more than 2,000 residents as a city, and notes that a home rule charter could later set a different name, according to the commission.

Put on the ballot by Citizen petition filed with the Boulder County District Court; election ordered by the court, which appointed the Niwot Election Commission on May 21, 2026.
