Background

The proposal to expand the Douglas County Board of Commissioners from three to five members came from a voter petition that qualified for the ballot on August 12, 2026; Question 201 asks how a five-member board would be elected, either three by district and two at-large or all five by district, according to the county.

On August 28, 2026, the board voted unanimously to adopt a resolution setting the ballot title for the petition measure, and on August 31 it voted unanimously to refer a related measure, Question 1A, asking whether all voters should continue to elect all commissioners if the board expands.

Petition representatives protested the board's addition of cost and funding-source language to the title; the board denied that challenge on September 3 and voted 2-1 on September 4 to keep Question 1A on the ballot, and on September 11 Douglas County District Court confirmed the board's authority in a lawsuit filed by Rep. Bob Marshall, according to the county.

The county says it had not had a citizen-led petition initiative since 1994.

Put on the ballot by Voter petition (qualified August 12, 2026); ballot title set by the Douglas County Board of Commissioners, unanimous, August 28, 2026.
