Explained

Today

  • Charter Section 5.08 lets Council adopt an emergency ordinance or resolution "to meet a situation affecting life, health, property, or the public peace." Adoption takes at least two-thirds of Council members (5 of 7).
  • Emergency legislation takes effect right away once signed, instead of after the usual 30-day wait during which it can be challenged by referendum. The Charter bars using emergency clauses for some matters, such as zoning changes, levying taxes and granting franchises.

If it passes

  • Council could also adopt an emergency ordinance or resolution "for the efficient operation of the municipality."
  • The two-thirds vote requirement, the duty to describe the emergency in clear and specific terms, and the Charter's list of matters that cannot be passed as emergencies would stay the same.
  • It would take effect if a majority of Olmsted Falls voters approve it.

Who would notice

Olmsted Falls residents, since more city legislation could take effect immediately without the 30-day window for a referendum petition, and City Council. It does not change any tax.

How it got here

The 2026 Olmsted Falls Charter Review Commission recommended it. City Council adopted Ordinance No. 38-2026 on June 23, 2026, as an emergency measure, to send it to the November 3, 2026 ballot; the ordinance says Council is obligated to submit the Commission's recommended amendments to voters.

In Commission discussion, members said emergency clauses are already used mostly for time-sensitive financial matters such as grants; one member voiced concern that the clause could be overused. The Commission voted 7–0 to recommend the change.

Background

Olmsted Falls City Council voted 6–0 on June 23, 2026 to submit this Charter Review Commission recommendation to voters. Council members noted that Council can approve or reject the Commission's proposals for the ballot but cannot change them. (Ordinance 38-2026)

According to the minutes, Section 5.08 currently allows emergency legislation only 'to meet a situation affecting life, health, property or the public peace.' The amendment adds 'or for the efficient operation of the municipality.'

A Commission member explained that non-emergency legislation needs three readings over about six weeks plus 30 days before taking effect, while emergency measures take effect immediately.

Put on the ballot by Olmsted Falls City Council, 6–0, June 23, 2026 (Ordinance 38-2026).
